1. Acceptance of these terms
By creating an account, accessing Hot Flash, or using any Hot Flash feature, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
Hot Flash is operated by TEK-PAK INC. References to “Hot Flash,” “we,” “us,” and “our” include TEK-PAK INC. and the Hot Flash service.
2. Eligibility and accounts
You must be at least 13 years old. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must authorize your use.
You are responsible for accurate account information, safeguarding your credentials, and activity performed through your account. You may not impersonate another person or business, create deceptive accounts, or sell or transfer an account without permission.
3. Vehicle profiles and permanent identity
You may create or manage a vehicle profile only when you own the vehicle, have permission from its owner, or clearly identify the profile as a concept, replica, tribute, fictional build, shop project, or other non-ownership relationship.
Hot Flash IDs and FlashTags are intended to remain associated with the vehicle. An accepted ownership transfer may move control of the profile to another member without changing the Hot Flash ID, profile link, QR code, or public vehicle history. You must not use transfer tools to steal, misrepresent, or interfere with another person’s vehicle record.
4. Your content and license to Hot Flash
You keep ownership of content you create and upload. You grant Hot Flash a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and technically process that content as needed to operate, secure, promote, and improve the service. This license ends when the content is deleted, except for cached copies, backups, legal retention, content shared by others, and content legitimately preserved in a transferred vehicle history.
You must have the rights and permissions necessary to upload your content. Do not upload copyrighted, private, confidential, or personally identifying material without authorization.
5. Community conduct
You may not use Hot Flash to:
- Harass, threaten, exploit, defraud, stalk, or impersonate others.
- Promote hatred, violence, dangerous criminal conduct, illegal street racing, theft, or evasion of law enforcement.
- Post sexual exploitation material, malicious software, spam, scams, deceptive promotions, or stolen content.
- Attempt unauthorized access, scrape protected data, disrupt the service, manipulate engagement, or bypass security controls.
- Publish another person’s private information without a lawful and legitimate reason.
Automotive discussion may involve risk. Content is not a substitute for professional mechanical, safety, legal, financial, or medical advice.
6. Businesses, subscriptions, and transactions
Verified members may be allowed to create business pages. Businesses are responsible for accurate listings, lawful services, customer communications, staff access, taxes, warranties, permits, certifications, and work performed.
Paid features may renew on the billing interval disclosed at purchase. Prices, features, taxes, and renewal terms may change with reasonable notice. Unless required by law or stated otherwise at purchase, fees already charged are non-refundable.
Hot Flash may help users discover or contact businesses but is not a party to work performed, quotes, appointments, vehicle sales, marketplace transactions, or off-platform payments between users.
7. Business referral credits
Referral credits may be awarded only after the referred member satisfies the qualification rules shown in the program, which may include verified contact information, a legitimate account, and creation of a first qualifying vehicle.
Credits have no cash value, are not withdrawable, may be applied only to eligible Hot Flash charges, and may roll forward as described in the applicable program. We may delay, deny, reverse, expire, or correct credits associated with fraud, duplicate accounts, self-referrals, automation, manipulation, refunds, chargebacks, or program errors. Program rates and qualifications may change prospectively.
9. Events, location, and real-world interactions
Event listings may be submitted by users, businesses, organizers, imports, or third-party sources. Details may be incomplete or change without notice. Verify schedules, rules, prices, safety requirements, and legality with the organizer before attending.
You are responsible for your own decisions, travel, driving, property, safety, and interactions with people met through Hot Flash. Hot Flash does not supervise events or guarantee the identity, conduct, qualifications, or reliability of users, shops, organizers, or listings.
10. Hot Flash property
The Hot Flash name, logos, software, visual design, features, and original platform materials are owned by or licensed to TEK-PAK INC. These terms do not grant permission to copy, resell, reverse engineer, or use our branding in a misleading way.
11. Suspension and termination
We may restrict, suspend, remove content from, or terminate accounts when reasonably necessary to enforce these terms, protect users, address legal risk, stop abuse, or secure the service. You may stop using Hot Flash at any time and may request account deletion, subject to lawful retention and permanent vehicle-history considerations described in the Privacy Policy.
12. Disclaimers
To the fullest extent permitted by law, Hot Flash is provided “as is” and “as available.” We do not guarantee uninterrupted operation, error-free data, event accuracy, business performance, vehicle condition, user identity, or any particular result from using the service.
13. Limitation of liability
To the fullest extent permitted by law, Hot Flash and TEK-PAK INC. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, data, goodwill, vehicles, parts, property, or business opportunities arising from use of the service. Our total liability for a claim relating to the service will not exceed the greater of the amount you paid Hot Flash during the six months before the claim or $100, except where a different limit is required by law.
14. Indemnity
To the extent permitted by law, you agree to defend and indemnify Hot Flash and TEK-PAK INC. from claims, losses, and expenses arising from your content, business activities, violations of these terms, unlawful conduct, or infringement of another person’s rights.
15. Governing law
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute not subject to another legally required process will be brought in a court with jurisdiction in North Carolina.
16. Changes to these terms
We may update these terms as Hot Flash evolves. Material changes may be announced in the service, by email, or through another reasonable notice. Continued use after an updated effective date means you accept the revised terms.
